General terms and conditions for online sales of LaFab entrance tickets

ARTICLE 1 – ACCEPTANCE OF THESE GENERAL TERMS AND CONDITIONS OF SALE

The purpose of these general terms and conditions of sale is to define the rights and obligations of the parties in the framework of the remote sale of tickets on the www.la-fab.com  website published by the “Fonds de dotation Agnès Troublé agnès b”. (hereinafter “The Fab”).

The Customer acknowledges having read these general terms and conditions of sale prior to the validation of his order. Any validation of the order implies acceptance of the general terms and conditions without exception.

The Fab reserves the right to adapt or modify these general terms and conditions of sale at any time. In case of modification, the general terms and conditions of sale in force on the day that the order is placed shall be applied to each order.

ARTICLE 2 – TICKETS OFFERED FOR SALE

2.1 Benefits to which the Tickets are entitled

Tickets give a right of access to the temporary exhibitions and/or permanent collections of La Fab for a given period of time.

2.2 Duration of validity of the tickets issued

Each ticket issued is valid only for the period indicated on it.

2.3 Availability of tickets

The Customer is informed of the availability of the desired tickets when placing his order.

ARTICLE 3- PRICE LIST OF THE SERVICES AND PRICE OF THE ORDER

The site offers several rates that depend on the type of visit concerned and the age or status of the beneficiary of the right of entry.

The rates for visits are those displayed on the _____ site at the time of the order. They do not include any additional management fees charged in addition on the day of the order.

The total price at the time of order validation is the final price, including all taxes and management fees included. It is included in the order confirmation e-mail and in the invoice. The prices of the visits and the total price of the order are stated in Euros.

The Fab reserves the right to change its prices at any time.

ARTICLE 4 – ORDER

The online ordering procedure consists of the following steps:

1/ The Customer selects the ticket(s) of his choice.

For each ticket, the Customer chooses, if applicable, the day and time of the visit, and the number of admissions corresponding to a given fare.

2/ The Customer creates a Customer account or connects to his Customer account by entering an identifier and password.

The creation of the customer account implies communication of the information necessary to process the future order: first and last names, address, telephone, e-mail address and date of birth.

3/ A summary of the entire order is displayed.

After having checked his order and taken note of these general terms and conditions of sale, the Customer makes the online payment of his order by communicating his bank details (card number and validity date) and by making a final click.

In the event of refusal by the payment centre concerned, the order is automatically cancelled. Any payment of the order by the Customer constitutes irrevocable acceptance of the order which cannot be questioned.

4/ The Customer receives an order confirmation e-mail.

ARTICLE 5 – TERMS OF PAYMENT AND PAYMENT CONDITIONS

5.1 Methods of payment

The payment of tickets by the Customer is made exclusively in Euros and by credit card. The following cards are accepted: CARTE BLEUE, VISA, EUROCARD and MASTERCARD.

5.2 Payment transaction

The Customer’s bank account is debited for the amount of the order as soon as the transaction is accepted by the payment centre.

In the event of refusal by the payment centre, the order is automatically cancelled.

5.3 Invoice

As soon as the transaction is completed, the Customer has the option of obtaining an invoice by logging onto his Customer account.

5.4 Security of payments

For bank card payments made on its site, the Fab uses the secure payment service of the server of its partner banks. All information transmitted from the _____ site to the payment system is systematically encrypted to ensure its confidentiality.

ARTICLE 6 – ORDER CONFIRMATION

6.1 As soon as the payment centre has confirmed the payment of the order, the Customer receives an e-mail confirming his order.

6.2 The confirmation e-mail acknowledges receipt of the order and contains the following information:

ARTICLE 7 – TERMS AND CONDITIONS FOR THE DELIVERY OF TICKETS

The ticket(s) ordered is/are, at the Customer’s choice :


ARTICLE 8 – CONDITIONS OF USE OF TICKETS

All tickets are systematically checked at the entrance to the site. This control consists of scanning the barcode written on the ticket (digital code).

Only tickets with a barcode and perfectly legible wording will be accepted.

It is the Customer’s responsibility to ensure on the day of the visit that:

Any partially printed, soiled, damaged or illegible ticket will not be accepted.

Any ticket with a reduced fare must be presented with a valid receipt. Only the following are accepted: identity card; certificate of unemployment benefit; job-seeker’s card less than 6 months old; large family card.

The ticket is only valid for the visit and the period indicated on it. The ticket must be kept until the end of the visit.

The Fab RESERVES THE RIGHT TO REFUSE ANY ENTRY TO THE SITE CONCERNED IN THE EVENT OF PRESENTATION OF A TICKET IN BREACH OF ANY OF THE CONDITIONS STIPULATED ABOVE.

The Fab will deny access to the Site to any holder of a ticket bearing a barcode that has already been scanned.

ARTICLE 9 – CONDITIONS OF REFUND AND EXCHANGE OF TICKETS

9.1 No ticket issued can be either exchanged or refunded, except in the event of cancellation by La Fab of the service to which the ticket entitles the holder under the conditions stipulated in Article 11.2. Cancellation is however excluded when it results from an event of force majeure as stipulated in Article 12.

9.2 In case of cancellation of a service by La Fab, except in case of force majeure as defined by the French courts, the ticket(s) will be fully refunded to the Customer within a maximum period of three months from the planned date of the service and on presentation of the ticket and bank details.

ARTICLE 10 – ENTIRETY OF THE GENERAL TERMS AND CONDITIONS

The Customer and La Fab acknowledge that these terms and conditions constitute the entire agreement between them.

If for any reason whatsoever, one of the clauses of these general terms and conditions should be declared inapplicable, it will be deemed unwritten without invalidating these general terms and conditions or altering the other provisions of the general terms and conditions.

ARTICLE 11 – SETTLEMENT OF DISPUTES

These general terms and conditions of sale are governed by French law.

In accordance with the provisions of Article L. 133-4 of the French Consumer Code, in the event of a dispute that may arise between La Fab and the Customer during the execution or interpretation of this contract, the latter shall remain free to refer the matter to a third party mediator or conciliator in order to reach an amicable settlement of the said dispute. In the absence of an amicable settlement, the dispute will be brought before the competent French Courts.
